We live in an industrialised world, where we are surrounded every day by engineered artefacts like machines and buildings. These artefacts all contain embedded risk and contained energies that can cause harm to people or the environment. It is an unfortunate truth that sometimes things go wrong, and harm is caused. Often, the harm is financial – but in the worst cases, lives are lost.

When something goes wrong with engineered systems, an investigation is usually needed to understand why, and so that lessons can be learned. Motovated have long experience assisting with investigations, and in acting as expert witnesses in court proceedings. Depending on the situation, our expert witness services could be engaged by WorkSafe, by lawyers acting on behalf of PCBUs, or by insurance companies or loss adjusters.

Our work in this area is led by our Operations Director, Joe Bain, who has extensive experience with investigation and expert witness work over 12+ years and a wide range of different cases. The work is supported by a tight group of engineers within the Motovated team who have also spent many years assisting with this work.

Meet Our Expert Witness Lead

Joe Bain – Operations Director, CPEng, PhD, BE(Hons)

Joe Bain is a Chartered Professional Engineer (CPEng), Fellow of Engineering New Zealand and Operations Director at Motovated Design & Analysis.

With over 12 years of experience in engineering investigations and expert witness services, Joe provides independent technical expertise across a wide range of mechanical engineering and workplace safety matters.

His specialist experience includes machinery and mobile plant safety, mechanical equipment design and certification, hazardous substance storage, engineering compliance and incident investigation.

Joe holds a PhD and Bachelor of Engineering with Honours from the University of Canterbury and is Chair of the New Zealand Society for Engineering Safety.

Working alongside Motovated’s experienced engineering team, Joe supports investigations and provides expert engineering opinions for regulators, legal professionals, insurers and businesses.
